So I will try to keep to the issue at hand. Again, this bill also bans providers of safe and legal abortion from receiving state funding, if I'm not mistaken. and to provide preventive care. This is a move that is clearly aimed at banning planned parenthood from receiving state funding for preventive services. That is a topic that is totally separate and non related to the topic that the lady was addressing. The reality is denying young people access to effective pregnancy prevention, will simply increase the incidents of abortion and the idea that we as legislators would put politics of proven programs and health of North Carolina teens is in my view wrong. the programs that plan parenthood has in place
to address things like mammograms exams for cervical cancer for all kinds of reproductive healthcare is something that is done for people who are eligible for medicaid and so if you look at where funding is coming from for planned it is not coming from the state it's coming from a federal government program that program being medicaid. The other thing that I would note is that the pregnancy rate of teens in North Carolina has come down since we have head this programs in place that address teen pregnancy, that make sure that parents are talking with their children, to make sure that teen sex is delayed. Making sure that we prevent teen pregnancies, and the spread of sexually transmitted diseases, and we need to focus on that. We don't need to focus on something that is tramped up, that is fake, that is just untrue about an organization, and so ladies and gentlemen I want you to think about the fact that we are talking about in programs that are located, one in [xx], one in Wellington we are talking about a total amount of money that is a drop in the bucket to this budget. $135, 000, it's nothing when you compare what is being spent in our overall state budget, they have good track records, they have good track records for preventing repeat pregnancies among teen parents and helping them graduate high school and isn't that what we're about? So let's move away from bogus claims and focus on the good that is done, I hope that the members will vote not to concur thank you. The first is that this whole national discussion rather than the whole national fear over this issue, is linked to videos that have been acknowledged to be heavily edited to a point that they are not accurate representations they really are fraudulent in terms of what they depict. Thank you, so the what I was saying is that the videos have been so heavily edited that they really do not represent a true statement of anything but started here in the national debate that we picked up on here in North Carolina. So the bill at this point bans future research donation for medical research and that may or may not be a good idea. It is not a good idea in the sense that it keeps research from going on and some issues that are important to people among them research on Alzheimer's disease, so in that sense putting the ban in is not a good idea but if people want to push for the legislation as such we do so it's just important first to recognize it's not based on reality on true videos but they are raised on doctored, heavily edited and untrue videos. point I want to make is about the whole issue of passing a bill that says that no organisation has any abortion performed on its premises cannot get the family planning money. Here you just have to focus just one more time on what Representative Fisher has said, if you say there cannot be team pregnancy planning then actually you are ensuring that there will be more young ladies teenagers who are pregnant and therefore face the question of whether they want to abort the fetus or not. So if you really want to scab team pregnancy you will not want to go forward with this ban on team pregnancy research just because an organisation and not just research but as services just because the organisation also is a private responsibility but not all its responsibilities in the list just a small quality responsibilities is to provide abortions as it is allowed by the law and allowed by US supreme court, so I would advise you to vote against it a concurrence motion thank you. First I would like to share some information about the Fetal tissue. Federal law prohibits the sale of fetus tissue for profit, and requires separation between researcher and the woman who donates fetal tissue, North Carolina planned parenthood does not participate in any fetal tissue donation. Fetal tissue sale research has been an ethical issue for health care professionals, scientist, politicians and religious people for years although fetus tissue research has led to medical advances including the development
of the polio and rivera vaccines in 1950. These two vaccines alone effectively eradicated a major source of child morbidity and not to retaliation in the United State. This research has also led to scientific advances in the scientific understanding of fetus development and in the diagnostics and treatment of fetus diseases and defects such as the causes of down syndrome, seals and mental retaliation as well as development of amino syntices ever diagnostic two, fetal tissue research has also played a role in scientific understanding of cancer, immunology and transplantation. At this time I would like to share with you the following statements of senator Strong Farmer, of South Carolina, a republican, when he spoke at the Juvenile Diabetes Convention. Ladies and gentlemen, I am pleased to be here today with representatives of the Juvenile Diabetes Foundation, and with others concerned about medical issues and supportive of the stem cell research. Late last year, public funded scientist made major breakthroughs in stem cell research. As you know, stem cells are the bodies basic cells from which all other tissues and organs develop. While a number of scientist challenges must be overcomed, before specific medical benefits might be realized. There is a great potential in this research. Scientists believe that stem cells can be used to produce a supply of healthy cells and tissues, that can be used for transplantation by replacing exiting damaged cells, new treatments and even cures for numerous diseases might be developed. There is a great optimism that life saving therapies might be produced. Cells and tissues capable to put transportation could include excellent producing cells to cure diabetes. Heart cells to rebuild damaged hearts and new brain cells for victims of parkinson disease or other neurological disorders. As a father, of a daughter with Juvenile Diabetes I know as first hand, the devastating nature of this disease. In addition doing my service in this senate. I have heard the personal pleas of thousands of constituents who are affected by various diseases and disorders therefore, I have been a long time supporter of medical research. I recognize that many modern bio technology developments are complex issues and are frequently controversial. [xx], medicine, religion, bio-ethics, and other disciplines have reviewed and continue to comment on these issues. I believe these discussions are beneficial as we seek to advance medical progress and the well being a patient without demeaning the value of human life. The National Institute of Health have led the way in medical research and must be actively involved in stem cell research. NIH support will ensure the basic research is a [xx] to move us towards clinical applications. We are on the verge of discovering the only way of treating and curing diseases which too long have led to pain and suffering in the lives of too many Americans. I look forward to working with my colleagues to ensure adequate funding and appropriate support is available to our national medical research community. I usually do not agree but this time I do, please consider what stand to a lot of people that are suffering, please consider not just yourselves, not just your ideology, not just your philosophy but other people that could benefit from the research that is done of fetal tissue, thank you. Representative Cunningham has addressed the first portion of the bill better than I can ever hope to. So I'll limit my remarks to just what's on page two, section three of the bill, and I scratch my head wondering why this provision is here. Members it's stating the obvious to say there is deep division in our society on the issue of abortion, and there is deep division within this chamber on that issue, and I think it's safe to say that no one of us is going to work out of here today with their minds changed on that issue. I'd like to think it's also save to say that everyone of 120 us here would like to see a reduction in teen pregnancy and would like to see a reduction in sexually transmitted diseases among'st teenagers. But this provision of the bill goes directly against that, and I think think it's there because of one entity that provides us just a small amount of those services. The effect of this provision would be to prevent the state from contracting with planned parenthood to provide the services that are mentioned there, which as the bill says family planning services, pregnancy prevention activities or adult lesson planning programs. Members there's a reason planned parenthood was chosen for over a decade and a half to provide services. It's because they are very good at it, they've taken evidence based approach to it that has been shown to reduce teen pregnancy. Over a hundred girls each year benefit form this program now there may be other folks out there they can pick up this luck but the point is plan parenthood got the contract because they were doing the best job at it and if we pass this law the best folks at the job won't be able to do it so I'll be voting against this motion because I want to see us to continue to do something about team pregnancy. For what purpose does the gentleman form Orange Representative Meyer rise? To debate the motion. Gentleman has the floor to debate the motion. Thank you Mr. Speaker, this is a very difficult bill to debate because this perfects our challenge for us to talk about in our society. I want to speak briefly on fetal tissue and then I want to speak on section three as well, it is really hard to think about what has to happen for our researchers to have access to fetal tissue, there is no good way to get fetal tissue into a research lab but once it gets to the research lab, it is used for incredible things and has benefited millions and what I'm think about today is the current research being done on Parkinson's disease. A disease that killed my grandfather and is affecting my uncle as we speak and the one that has devastating effects on those who have it and those who care for them and we can't let the benefits that come be outweighed by the unpleasant nature of how we get the fetal tissue. Under section 3 of the bill that as Representative Martin just spoke to impacts plan parenthood, many of you have heard me speak on the floor before about my experience running programs for teenagers before I came in to the legislature, and I worked with many young women who had to make difficult decisions about what to do about teenage pregnancies and they chose various things to do in response to being pregnant as teens, but I want to speak to you for a moment about young men and teenage pregnancy I was running a summer camp program and late one night laying in the bank trying to monitor a group of teenage boys who were not inclined to fall after the lights went out, their normal conversation, late night conversation about the girls at the camp and all kinds of gross jokes that they can come up with in the dark, turned to a conversation about their fathers. The young man in my cabin to a man did not have an active father in their lives and they spoke for hours that night in the dark about what that meant to them, what it was like to have a father in jail to a father that had abandoned their mother and never spoken to them, to have a father that only came around when he had money or needed money was painful and impactful to me because I didn't grow up in that situation but I listened and I learned almost every single one of those men with a product of a teenage pregnancy, it takes two to create a pregnancy, and
even when a teenage pregnancy results to a child birth and these young men were incredible and I'm very glad that I got to know them and they were in my life, they were still impacted by teenage pregnancy that lives were impacted forever by teenage pregnancy. The single best teen pregnancy program that I saw in my experience was one that was run by planned parenthood. What they did was they trained teenagers on how to talk to each other, about how to prevent teenage pregnancy and sexually transmitted diseases. It din't depend on me as a social worker talking to young people who were really uncomfortable talking to this old man about what to do, it trained the kids to communicate effectively with each other they not rely on rumor and not encourage each other to do things that were dangerous. I don't want to see any of the young men who I got to know in that program not be in my life and not have the opportunity to be in this world. I don't want to see anymore abortions because I love those young people and to me the best way to prevent those abortions is to have effective programming so the young men like that have opportunity talk in meaningful way with each other and learn how to avoid the teen pregnancy mistakes that their fathers and mothers made and we need plan parent hood as one of the most skillful providers to be able to do that in our society and therefore section three of this bill just goes too far and I recommend that you vote no and not concur. Thank you and I've been here for five years and we've had a lot of bills that are similar to this and I've never spoken on any them, I've sat and listened and listened and listened and I've listened till I'm about listened out. So I'm going to speak this time I notice that one of our first speakers claimed that if a tape is edited or heavily edited it does equal being false. I would say if that's the case then, every news story I've ever seen about about the general assembly or channel five or channel 11 or any of the rest of the them is partly false, because they're all very heavily edited. I also noticed that when she was offered some evidence of these things that are indeed not false, she did what any good person without any proof on their side does, no I don't want to see the evidence there's no denial this is going on in the United States in North Carolina, I hope it never does happen in North Carolina, that is the whole purpose of this Bill. Another Representative mentions a former Senator Former US senator on stem cell research if you noticed the word foetal was never used in that speech that is because 90% of the progress that's been made on stem cell research has been made on adult steam cell not fatal since the research although there is a portion our country that wants to continue to push that it was also basically said that we cannot have team pregnancy reduction if we do not have a group doing it that also provides abortion, that is not true our volunteer back home with the group is very good at offering services that does not provide abortions. You all are going to be amazed that through the years we have people who say that we all agree that abortions should be safe and infrequent but available, cannot bring themselves to vote for bills that would for instance make a clinics have the same safety and emergency features that every other outpatient clinic has in this State, therefore providing women with the safe alternative. Some can even bring themselves to vote against something which mandates against the sale of body parts, it's incredible to me, we make sure that stay but we don't back it up when the votes comes. As far as de-funding planed parenthood, it's not surprising to me the things they are doing. It's not surprising me the body part sales they are doing. Now this is an organisation that was founded by a woman who was a preacher of eugenics and a great admirer of the Nazi attempt to create a master race. So anything they do doesn't surprise me, I'd advise you to vote for this conference report, thank you. Mr. Speaker. For what purpose does the lady from Orange Representative Insko arise? It's been said already by colleagues that no one in North Carolina sell body parts, no body in North Carolina is involved with fetal tissue, some of us were concerned enough about it under the leadership of representative Cotter Cunningham, to set up a meeting and talk with some people in North Carolina with planned parenthood, because we were concerned about the national problem with the videos circulating throughout the country, and indeed because of that we do pointed questions were asked about this very issue and the answer was no one in North Carolina does this And we followed up and found out that this was in fact true so we cared enough about the issue to bring the parties to us and we inquired about the serious issue, and how it was impacting North Carolina. And we discovered it was not impacting. The next thing I did after that meeting was to talk with people involved with teen supervision initiatives and projects in North Carolina. And I thought this bill was going to be impacting on that from what I read in it so I want to say to you that I see it as a waste of time, waste of money and our tax payers in North Carolina deserve better than this because it's not an issue here folks. When we have people that cannot get sufficient mental health treatment, cannot get substance abuse treatment, do not have food, on clothing and housing, and we're doing this on the floor of The North Carolina house it bothers me. Our constituents in North Carolina deserve better than this folks, and you deserve better than this, because we're about the people's business and we're trying to close out this week and what we're talking about is something that's not happening in North Carolina folks, and I love Sarah Stephens, she is a friend of mine, and she and I have shared some good relationships but I say it's a waste of money and time. We can call it fetal tissue, we can call it all kinds of things, but the bottom line we're talking about a baby, we're talking about a human being, we're talking about legs, and arms, and brains and my God how did we get here how did we get so carlous that this doesn't matter It just tears my heart out that we even have to discuss this I've got twin Grandsons that were born months prematurely at only six weeks one of them weighed one pound three ounces the other weighed one pound six ounces, and I weighed night and day for weeks and whether they were going to make it. I'm proud that they're happy six year old boys. But my God I could not even think of selling their body parts. They're were the smallest human beings I've ever seen some people would have still referred to them as foetuses and it disgusts me I don't understand and how anybody within feeling and could oppose this bill, this bill and marketing in sale of unborn children body parts my God. Let me say this, let me tell you a story. A representative stood up just a moment ago and talked about the young men of teenage pregnancies. I'm going to tell you a story about myself. I don't know my father, never met the man until I was 22 years old and that was enough for me. My father, when my young mother got pregnant, wanted her to have an abortion, sent her money to have an abortion, went to court and said, I want her to have an abortion under oath and my mother actually thought about having that abortion and instead of going to that abortion clinic, she went to a place where they talked about preventive measures and they talked about the what now. That's what we can fund, that's the opportunity we have as well on this bill. It's to fund organizations like the Carolina Pregnancy Center where they talk about preventive measures but they also talk about the what now members I stand before you today not thinking I'm going to change a single mind, but here is what I'll say to you and what I'll press upon you. I stand before you today, as a husband, a father of three, an entrepreneur, a state representative and I'm 35 years old my mother made a choice to ensure that I had that opportunity. They should not pick losers. How we should let market-based solutions, let the market determine who's a viable organization, who's a
viable entity and who's not a viable organization and who's not a viable entity. I think that this legislation is the opposite of that. It is choosing, it is picking winners. It is picking losers. It's saying, we are going to fund this particular organization and not this particular organization. We, as a legislature, is going to choose what is best for the community Vance, what's best for the community of Granville, what's best for the community of Warren. I'm sure every single one of us has good programs in our districts that offer the same services as Planned Parenthood offer. Why not let the market determine which one of those organizations is going to remain viable? If Planned Parenthood has a history or is not doing a good job of helping teenagers planned pregnancies then there ought to be the statistics and numbers out there to show that and back that up, and let's make our decisions on who is going to get funded and who's not based on those actual numbers data, not on a story and anigble that we heard about something that's taking place half way across the country why is it important? Well I've read articles about what is going on in South Carolina legislature totally crazy what's going on in the Virginia legislature I don't agree with, it's totally crazy but should I be punished for what they're doing over there in Virginia legislature? Should we hear in the North Carolina legislature be held accountable for laws that they passed down in South Carolina legislature? Why in the world would we hold North Carolina planned parenthood for an anecdote that we've seen or heard about what's going on at another location. You wouldn't want to be held to that same standard we would not want to be our funding to be tied to what South Sacramento legislators are doing. It wouldn't be fair if our funding was tied to laws that Virginia legislature had enacted and that's what were dong here to plan parenthood. So for example, what if I am sure we have heard stories about doctors, who have inflated their medicaid medicare reimbursement numbers. Some bad actors out there doing illegal stuff. Nobody's condoning that. Do we ban the practice? Do we preclude all doctors from sending in reimbursement funds do we say because one doctor over here did something crazy none of the other doctors are going to be able to get re-reimbursed by the government I just think that's not a logical reaction or not a logical reason way to go how to reason a solution here because I do think there is a solution here Now, we don't know, lets vote on this thing because its reaping out our hearts talking about listening to folks talk about, we would not be talking about it. I guarantee you this bill would have passed in two sections if it didn't have section 3 part H on there which is about the money which is about the funding. Nobody in this chamber is going to vote against selling body parts not one person and if we had that bill in front of us we would not be debating now. But when you insert this insulator provisions there yeah so now we are going to debate so now folks heart are going to be reaped out and you are going to hear about it because I would rather have that debate now be thinking of how I will be impacting how difficult for us to talk about this stuff to hear about this staff than a little teenager next year who is trying to make an informed decision about how to deal with her pregnancy and we have limited her options up here now you can go see planned parenthood you are trying to go seek counsel seek advice, seek education about how to make an informed decision. How is that girl going to feel about how is she going to feel is it going to reap her heart out next year is is going to reap her families heart out next year we have limited her options, so I would have voted for the bill if it did not have section 3 part 8 in there but since we are holding planned parenthood North Carolina accountable for what other plan parenthood's may or may have not done all across the country we have got to talk about it we have got to debate about it and so that's why I will be voting no. The idea of saying that planned parenthood in particular since that name has been raised would want to reduce the number of abortions is ridiculous, it is like saying that the local bakers is going to go round asking people not to eat bread. Unless that's what you make your money on you're not going to get that stopped yeah will try to reduce, you are going to try to produce more but so you give out contraceptives that don't work contraceptives that you know are going to fail to produce more business and that's what is going on. For the sale of this body parts I will liken to something that can happen well it was actually before I was even born there was a very nice German family who lived in newbourne. He received a gift from friends in Germany a lamp with a lamp shade they quickly dispose off when they realized that the lamp shade was made of Jewish skin. There's no difference between what was done there and what people are doing now in selling these little human being body parts for profit. No difference at all it is ghoulish and it's like saying well we shouldn't bother about I want the Nazis did in the concentration camps because it kept the trench running on time. You think they did something good and so you're going to tolerate the murder that they made most of the money for ourselves. The restrictions that are in there, the only one that really concerns a condition is that it has to operate during daylight hours. This that occurred in my county, we had a fellow taking a large combine as wide as a road across a foggy bridge in the morning and unfortunately one of my nurses ran into that combine and was killed. What my amendment is intended to do is to specify, that you're not to have equipment that goes across both lanes of the state road under conditions in which you can't see. Is that true or am I just reading it wrong? Well Representative there I wouldn't use a word that would eliminate their ability, but you take for example the farmer that's just come by and he's driving down, he's already on the road and the conditions were permissible for him to do it at the time, and as you know sometimes in harvest season particularly this time of the year it doesn't take long for it to get foggy, and so he is on the road, and I think that's the kind of issues our Representative Baumgardner takes more detailed thought than what, has been so far, but I do commend you for your concern and I think going forward that's an issue that we can address, but I don't think this accomplishes properly what needs to be accomplished For what purpose does the gentleman from Camblin, Representative Ford address? They still have to go through license, they still have to attain the property from LRC shows sustainability, USDO requirement still need to be met. I had to deal with the
appeals process on CON compete against a multi-million dollar facility that [xx] has put in and deal with prime issues so there are lot of other issues for Belhaven to go through, but this would just simply say that they don't have to go through the CON process again, but again this could be related to any other royal hospital that closes, one of my other hospitals Washington county hospital is another one that may very likely close and right now DHHS does not have a policy in regards to how long you can be closed without being an existing facility, they don't have case law just afford any decisions that DHHS would make and there's no statute that would also allow any direction for DHHS so this gives some clarity as we go through some of this real organization with our rural hospitals and Mr. Speaker I understand Representative Dollar has a friendly amendment with your permission, thank you. Mr. Speaker I am going to speak to my interest in this just for a few minutes, but first look on your desk if you will, there's opinion piece [xx] to the editor from the Washington Daily news of last Sunday not yesterday but the Sunday before, it's a HP 20, this was an HP point at one time it's now senate bill 698, but by this letter you'll see an outstanding citizen, a pastor, I understand pastor of a church Bel Heavens that explains sort of what the mayor has been
up to as far as this campagn he has been on about this hospital and then I want to explain my interest, a lot of you have questioned why I'm interested in this, [xx] last December, I started asking my brother who was a resident in this town for that last eight month, for the first six months and then last couple of month I've had to pay attention to Beaufort county a lot more I had a bout the situation and some of the tactics that were being described that I will be describing the senator and the representative how do you respond felt constraints from getting into this, I totally understand. I don't get into local disputes in my town either, but is North Carolina, I couldn't just walk away people seemed hopeless to fight I consider a big bully. As of last week the mayor choose to partially question my motivation. Some of you got an email about that, and thereby he drew me into the discussion. Before you vote you need to know the real situation on the ground and what kind of people you're dealing with as well as a few facts about, what is going on there as far as verdant[sp?] and the investments they are making. A few of the facts a membership of a community based LLC which has been referred to, that owns the old Belhaven hospital facility, the building is made up of over 100 members, many representing families that contributed to the hospital over many decades. The first part hospital was built in the 1940's is now filled with mold and asbestos and other products that make it basically unsuitable. when the facility was closed in July of 2014, the average visits per day was four visits per day and was over $1.5 million in debt. The community based LLC membership voted overwhelmingly to go with the verdict health proposal for a new multi special facility, rather than the current Mayor's proposal to reopen the old facility with loans from the federal government which will be $6 million and now he's looking for from the USDA by the way. So his newly formed LLC, which he is the chairman of the Fungal Medical Center LLC, which is newly formed he's the chairman, a friend of his on county commission is the vice chairman, and a friend of there's is the secretary so as they are telling you room for politicians trying to operate the hospital. Guilford and Hise County boards of commissioners by unanimous or overwhelming margins have refused to loan money to the town of Belhaven to pursue the eminent domain proceedings to seize Bel Hospital property. He wants to seize the property by eminent domain from the current owners and give it to his LLC. As a great [xx] with the community based LLC if I don't [xx] building 24/7 to have a clinic services building, supporting several families practices in building a $5 million multi specialist specially facility when they headed up here they were open in June 2016 they would employ 52 people and they had a payroll of 3.7 million. This is at the current clinic and family pracs is nearly 100 per day compared to four which proves that this is a safer model for the area. This is the 21st century model not the 1950s model. In addition for higher counties are both expanding and outgrowing there emergency medical facilities EMS to paramedic level and that is actually given $500 000 to vote for county I am not sure whether they were given the hide or not but four hundred upgrade there image facilities and I know somebody today that they are the same distance from the Washington hospital that I am from the South Ward hospital in time 20/25 minutes, so that's been a big deal about the money [xx]. They also have EMS and a helipad and a helicopter serve, medicaid service, fully staffed 24/7 at the Washen[sp?] airport just a minute from Belhaven and Western North County, the new miles were effective and efficient rural health care is thriving in Belhaven through partnerships with the public and private sectors and the proposed waiver for BellHaven in this bill will slow down or stop the private sector side of these initiatives taxpay dollars and result in less health care choice in access of the bill highway[sp?] area. The 1950s mental[sp?] hospital is proposed to occupy an obsolete building for the mold and asbestos a bill the mayor wants to see which I have always stated and give it to his personal LLC, then he wants a $6 million loan from the USDA which of course, he can't get
without a bailing or a CON. A vote for this bill will help enable him to pull off THE scam and compete with the private investor using taxpayer dollars rather than private funds. So if you're for using taxpayer dollars to compete with private entity, then you should vote for this. If not, you should vote against it. Thank you. Ladies and gentlemen, this is not spending a dime to do anything. This is just nearly giving the mayor. I mean, they have the mayor of the town and they had a county commissioner walk all the way from Buffalo county up to here, to try and gather support for this. All we are doing is keeping the state out of the way so that they can make an attempt to get this place open. Now whether they'll succeed in opening the hospital again or not, there's no guarantees, but if this is what they want to do, if this is what the mayor was elected to do, if this is what the county commission there wants to do or however many of them support it, that's what we're doing, this is Beaufort county, representative Tine and myself represent Beaufort county and while this is specifically in his district I support people doing what they want to do, I've receiver no opposition form this. Okay so there's an opinion anybody can write opinion on what they like, I understand there's some personality conflict between representative and a mayor but all we're asking you to do this is not going to cost us a dime this is just saying look if you want to go through all the changes that are required to do this try and get all this certifications and do all this stuff we're not going to stand in your way. That's all this is, so I'm asking you, let's support our local folks and let them do what it is that they are trying to do if they are able to do it. Mr. Speaker, members of the house, I didn't know it, you didn't know it, but I have magical for powers, without communicating with anyone or knowing what was going on, the budget conferees of which I was nominally one but not actually involved in the budget, inserted a provision they put a cap on funding for the Durham-Orange light rail at 500, 000 apparently killing deal but apparently my magical powers extended to without me even thinking about it I got our conferees to put it in there and you can read all about it in my local paper, the News and Observer where they gave me credit for this. Well, I was initially please with this because I'm not a fan of light rail I don't see how it can possibly be economical, but I found out later that in fact under our strategic transportation initiative that program
actually scored well and was possibly going to be funded. Well I'm a numbers guy and I said, well, that's pretty good. Well, last week in finance on this Bill, I happened to see in the Bill, another provision that was going to delete Wake County's Rail Program although it's not light rail, well, I'm not a fan of that, I'm not a supporter of that when they ever going out for a referendum I'm going to fight that referendum for various reasons, but the provision in this bill in the finance say that if Wake county tax it's own citizens for this purpose that therefore we get no state funds which to me is exactly backwards or opposite of how you would phrase something so with the consent of the proponents of the bill we took that out. Well I would ask you to take that provision out of the budget bill as well because it just doesn't make any sense if we are going to have a strategic transportation we ought to go by numbers, again I'm magically inclined and somehow I think I can maybe manipulate those numbers by osmosis to the department of transportation and show them that really it's not a good idea, but until that time comes I think you ought to vote for this amendment. Thank you Mr. Speaker. Senate bill 676 creates a new code section that addresses health benefit coverage for the diagnosis of autism spectrum disorder. The bill requires certain health benefit plans to offer coverage for autism spectrum disorder. The bill defines Autism spectrum disorders by reference to the most recent additions of two manuals, but Autism is expressly curved out from the definition of mental illness in lines 43 and 44 on page two of the bill. The operative portion of this bill can be found on page 3 at line 16. Except is provided in subsection C of this section health benefits plan shall provide coverage for the screening diagnosis and treatment of autism spectrum disorder. Now the reference to subsection C is a reference to a cap or maximum benefit of up to $40000 per year and they'll be limited to individuals 18 years of age or younger, the bill goes on to provide that coverage cannot be denied on the basis of the treatments, or habilitive[sp?], or educational nature that coverage may be subject to co-payment, deductible and co-insurance provisions that similarly apply to a substantially all medical services covered by the healthcare plan. Now the controversy over the past several months around the bill has related to the provision especially curving out autism from the definition of mental illness. The reason for the angst was that one, most people view autism as a mental illness, and two and these is more importantly there was a fear that department of insurance and or the insurers would exclude autism for purposes of mental health parity under federal law, now that's a term of art and the science sponsors and I have worked on this issue and not having found a way to meet the senate's concerns about how this bill needed to be drafted and we went on a different angle and if the concern was that the department insurance or insurers would somehow misinterpret this law in a way that didn't realize that autism except for this one type of therapy was obviously a mental illness and would otherwise be provided with federal parity. The way to approach that was actually get the Department of Insurance and get cross blue shield and the insurers to agree as to the interpretation meaning that no one is going to misinterpret this law as not allowing mental health parity with respect to autism with respect to the other types of therapies other than this one that will necessary to allow for the caps that in the bill, all of this it relates back to the caps that the senate very much felt needed to be in the bill and I would tell you that both the autism society in North Carolina and autism speaks for perfectly fine with, so I would describe this as a walk around, and I gave everyone of you a copy of a letter that came from Blue cross Blue Shield and the letter hopefully speaks for itself but basically it will cost Blue Shield states that
it fully intends to provide treatment for autism at parity and follow the requirements of the federal law and with respect to the Department of insurance while I'm not sure if they needed to be any further clarity. If you look at page three line 45 the 50 subsection I is actually slightly amended and at the request to the Department Insurance, I again and the Senate actually did make clear that while for one type of therapy, purchase was not considered a mental illness because you need, there was a desire to have caps's to the cost of that type of therapy for all other purposes Autism will be deemed as mental illness and thus triggered the Federal Parity Provision. Now I became a lawyer for a reason, both my parents were doctors and I never want to carry an insurance or medical bill on the floor of the House again, because this is really hard stuff but I will tell you I think we've got a good solution here, and it wasn't the way the House Bill was drafted, but I think it gets to the same twice. I have circulated both the Insurance companies letter and an explanation of how we're doing that to a number of really engaged activists many of you have gotten emails from me recently, as you can tell I have been trying to work with the broader Autism Community over the several last months, I would tell you that this is a good Bill, first I think it clearly expands coverage and mandates coverage for Autism and its really important that we adopt a bill and put this in place, because early treatment of Autism makes all the difference in the world, and frankly I didn't want and I hope we won't be responsible for not putting this in place as soon as we can, and beginning the therapy for many youth that can use this coverage, and use this therapy. The purpose of this bill is very clearly stated on page one line 16, the purposes of this article are to establish an agricultural pilot program for the cultivation of industrial hemp in the state to provide the reporting on the program and to pursue any federal promise so ever as necessary to this industry. I wanted to give you just a little bit
of background on where this bill came from, this bill is actually proposed to me or suggested to me by some farmers back in my district, currently the United States is the world's largest importer of hemp most of which comes from China, and passing the 2014 farm bill, Congress legal as the growth or cultivation of hemp containing 0.3% or less THC, provided the state law would provide such a program currently North Carolina law does not allow for such a program. 23 other states do allow cultivation of industrial health and some form or rather. Without the 25, 000 uses Hemp is incredibly versatile in fact during the colonial era, Hemp was considered such an important resource that many of the colonies required their farmers to either grow hemp or pay a fee for not growing it, during world war two the united states government launched the hem for victory campaign to encourage farmers to apply for special license to go hunt for roads for the navy. North Carolina climate and growing season are idea for the production of Hemp, Hemp fits well into the soy bean and corn crop rotation cycles and if planted before soya beans or corn it acts as a pesticides actually cutting down on the need for chemical pesticides and increasing crop yield. It's also very similar to tobacco in and requires the a lot of the same equipment which we give our tobacco farmers who've had their contracts cut an alternative for production without having to borrow new equipment. Spring Hill North Carolina about 30 miles East of here is home to the largest decortication plant in North America and the only one in the United States. Decortication is a process by which hemp fiber is removed from the stalk of the plant because the profitability of cultivating hemp is largely dependent upon proximity to a decortication facility, the Spring Hill facility will give our farmers a leg up on this if we indeed go into this pilot program I won't bother you in giving you all 25, 000 uses of this plan, just give an idea of the variety of things it's used in. It's used in luxury vehicles to reduce road noise, it's used in building materials infact, camp insulation has been shown to help asthma sufferers and according to some of the advertisements that I have seen on TV lately apparently, that is a very important issue to some of my colleagues on the other side of the aisle of it's also is used in bed sheets, in fact a lot of hospitals use it in bed sheets because it actually cuts down the risk of staff infection. It's used in everything from clothing, shoes and handbags, to lotion and beauty products and fabrics. Infact the flag that Betsy Ross sold was made from Hemp fiber, and a lot of other things. This bill has been drafted in consultation with the department of agriculture and the shares association and the county commissioners association nicely has put this on their legislative wish list for this year. If you have any questions, the other thing I'd like to say is one of the questions that keeps coming up is can someone smoke the stuff and get high it's like a cheap form of marijuana and the answer is absolutely not in fact the 0.3% THC maximum limit on this is only a third 0.9% limit that we passed last year in the cannabinoid oil that is used to treat seizure disorders and by the way this product can also provide that oil that would be used to treat seizure disorders and also falls below the limit that we passed, I would be happy to answer any questions. So my amendment addresses that concern by requiring that the board have at least three final candidates submitted to it and that those candidates names and especially their resumes be open for the people of North Carolina who are going to hire them, to take a look at and that also require just that the board have one open meeting at which the candidates were discussed. It wouldn't prohibit the board at all from having meetings behind closed doors to have more thorough vetting and discussion in comparison of the candidates, but at least those requirements have one meeting that's open to the public for that to be discussed. However we together [xx] a new story for North Carolina a new vision of leadership and responsibility. Working ahead and leading for decades into the future. We've had a lot of successes in North Carolina. Reported job growth is willing to top three in the nation, $445 million budget surplus, North Carolina unemployment reforms have paid off billions of dollars in debt to the Federal government and we have reduced the insignificant manners the tax burdens on the hardworking families in North Carolina ladies and gentlemen, we have a non-precedent and an opportunity and responsibility to restore their confidence and a better future. This is a common sense plan of action that does that. Imagine being able to have a plan that provides almost 50% more debt free by paying In cash for the things the state needs. This is a common a sense and affordable plan of action that does that imagine putting the people of North Carolina and control imagine letting them to sign their future, I trust the people and their wisdom and judgement, this plans put
the people in control by making this bond vote a vote of the people. Now is the time, now is the time to get North Carolinians the tools they need to help build future. Do you think it will cost less to build in the future? Do you think the interests rates will be lower in the future than where they are right? So many see the American dream as a well paying job and to build their own home, being able to spend quality time with the family, this plan invest in high tech jobs, the Ag industry, and the quality of life issues that matter to the people of North Carolina. North Carolina is one of the highest in the nation where people graduate stay here, therefore this plan invest in the science, in technology, in engineering, math, health or related fields in our universities so our children can graduate in these fields, stay here and contribute to the new high-tech economy, and the high-tech agricultural industry. This is speaker, May I speak on the Bill please? The gentleman may debate the conference report, I spoke on the Bond and when we first came up a couple of weeks ago whenever I was now and because I'm speaking with the debt free plan but apparently it didn't go over too well with everybody, so, but I'm going to stick with it constantly, and that's what you'll hear. But I wanted to speak a little bit on this here. To begin with, I want everybody to be aware of what we are doing, literally what we are doing. About four and a half years ago, the Republicans came under control, and you know what our battle cry was? Governor Peru ran us to nearly 8 billion dollars in debt, and we screamed and hauled about that. And what we did was, we decided we we're not going to borrow, just plain and simple as that. So, we just borrowed just minimal last year but basically, we weren't going to borrow. And we didn't, so what does that do four and half years later? We paid down the debt. A couple of billion dollars. Now just so you remember just so you will know exactly what we are going to do we will go back up again and that's okay because we're Republicans we can do this. Just want to start it all if the speaker will permit a little preamble on this whole issue and the reason why I got preamble is because I'm probably the most unlikely person or council to be up here complaining about debt, but I think I have a very good reason. I'm a contractor and as you know, over the last seven years or so, we've been a pretty heavy recession and which basically got it out my industry as well as real estate and mortgage lending, I was just starting to recover. So I went through that and I'm not complaining that I had to do it, my wife, and I we had a lot of faith in God and trusted it into His hands and we got through he did and during that time I was able to run for office which I did and won, but I wondered why, in the world, did God go through this. Was there something I had to learn or something like that because basically [xx] extremely well funded business and so I decided well, I said he did teach me something and here's what I figured I learned. Three things: One, that bad things can happen because of situations beyond our doing or our control basically, if something like that happens, do we have an escape strategy, a strategy at all, does this state have a strategy
in case it ever ends up in the same situation. We say we are going to put a billion dollars aside, but you know, we'll burn through a billion dollars really quick. The second is, can happen so fast that it can catch you unprepared. We are through our reserves but you know what, we live in a really volatile world and so what we're doing is not only our reserves, we are spending our additional reserves and the third thing is the intensity of the crisis is never known until it's too late to adjust, that's why I want to be debt free, basically is we can adjust real quickly but I have that personal interest that I lived through this recession and it was hard work so what we're doing is basically we're spending $2 billion of our reserves on projects that as I'm going to go through, I'm not going to through every one of them but I'm going to go through a few and to say we don't really need to spend this money so I want to talk to you about backs and I'm not talking of business person to business person, and I want to start with universities which is the bulk of this one billion dollars or just about that. If you had a business that had 14 separate sites, if none of them were operating in to capacity, anywhere near capacity, would you spend your money trying to do something to enhance them? Would you physically reach into your own pocket and take out that money and spend it on something where you knew there was capacity to do without it and so what I did was, I said that this thing over here it's four pages and basically I run through it pretty quickly but this I'm hoping should address the point. On page one is the UNC system totally and as you can see by the chart we have a target area which is the supposedly capacity of the university which is really less than the actual capacity, as you can see on the first line the UNC system itself is way under capacity and requires the actual numbers down at the bottom in the graph. So it took a couple of universities you can see on the left hand side you can actually go in this website by the way this is the university of North Carolina website, this is an advocacy website of any sorts and you can pull any one of these up. The first one I actually look at NC state and you can see answers on page two, you can see they are all so way under capacity. In fact you can see if you look at the numbers on the chart down bellow you will actually see that over the last five years is still pretty much the same, very little growth The page three is the one I'm going to concentrate a little bit more on and as the UNCC or University of North Carolina in Charlotte. And you can see they touch their theoretical capacity but they are still way below and it's on this chart is not only does have class room it has lab. So you see both those and the last page, page four, this is your daily usage and the system as a whole. And you can see by the bar graphs the system at whole never reaches 50% of actually uses on the days that they have classes. In this particular one I've selected 8am to 5pm, and the capacity is 35 hours of usage per week which there is no reason I can't go to 40 hours, but I want to drill in little deeper on the UNCC1 and just give you an example total room usage at 8 AM is 25%, 10AM is 30, noon is 51, 2PM is 47%, 4PM is 25 and 6PM is 35, you can see that if you look at those figures you can practically double the enrollment that you and UNCC never touch your total capacity so that's basically what I'm saying is we just haven't reached our capacity. We're supposed to be doing business
out of state, if you run your business like this where you are going to find things in another capacity you would be out of business unless you believe the tax dollars using tax dollars doesn't require us to use incoming business practices, so I'm going to finish up because I think I'm pretty much out of time from the close, a couple of other things that are really interesting in this Bill were, I'd say you should oppose it, on page 3 line 89 we say that we can borrow from any Institution whether in the United States or others out of the United States looks like we may be potentially borrowing from China. I don't know how everybody feels about that, but so that's a possibility. The second one is that Representative Bob may appoint to say we look at how quickly we're going to pay it off, it is a possibility but you know what the Bill says that we can harmonize this up for 40 years and anybody whose done any decision, have you look at your hard one statement or well you bought a house, you'll see that you paid your house make payments for the 30 years you'll almost triple the cost of what you pay, so $2 billion if it happens, are we going re-session again we slow down whatever we do we'd be possibly be paying this for 40 years it's [xx] in the bill which will be paid at $2 billion we may be up to $6 or 7 billion by the time we finally get done paying this. And last of all my favorite one in the whole bill The gentleman's time has expired the chair will give the gentleman 30 seconds just to conclude very quickly. That's all I really need thank you sir, is the soil and water grants, we're going to borrow money for 20, 30, 40 years, and we are going to give it away, that's really not a good business model and I ask you to oppose the bill, thank you. For what purpose does the gentleman from Union, Representative Arp rise? To speak on the bill. The gentleman has the floor to debate the bill. Ladies and gentlemen I just want to I am not trying to get into and extended debate in this late hour but I just cant sit back and let misinformation, frankly wrong information go out. My good friend Representative Bradley is just wrong and I don't think he really understands the bill. He talks about the debt going back up, right now we have $5.7 billion in general obligation debt 5.7. Next year goes to $5.2 billion and the debt even cash flow in this bond never goes higher than 5.2 billion dollars, in fact this is a six year capital plan, and at the end of six years we are less than, we were more than $1.1 billion less in debt than where we are today, that is the fact, that is our. Also talked about water and resources, and got to this point and there is water resources are actually going to be put into a loan fund that goes out, helps the counties, comes back, and it's a revolving loan that does that, in fact I'm so much in favor of this bond because it is a wise business decision. I'm a small business man, I don't know of one business that does not use money as a tool, and capitalize on future cost today, when we can prove and in an objective finance way, that this is cheaper and makes more sense. Ladies and gentlemen I urge you to vote yes on the Bond. Further discussion, further debate? For what purpose does the gentleman from Durham, Representative Paul rise? Speak on the Bill. Gentleman has the forward to debate the Bill. Thank you Mr. Speaker and ladies and gentlemen of the House, I know it's is not that late after all, but the question before us is probably not whether, or not we should do all the great things this Bond says we can do. The question really is, do we do them in this fashion? Do we finance this improvements that we so badly need in this fashion? And when I say in this fashion, of course you have to look at, what have we
recently done with our tax policy? What have we recently done regarding the tax burden on our middle class? And yes there's no question that we need to have these improvements on our state. We're behind and billions of dollars on transportation which is not in this bond and I understand that. But money is tangible we spend it in different areas and therefore we have capacity in other areas. So yes, we need to do a lot of the things in this bond. But again the question is, how and who's paying for it? This this is not divorce from our Tax Policy that has really increased the burden on many of our middle class and working class families and so the bond has merit, the projects that need to be done, need to be done. But the question is, how are we paying for it and why are we borrowing what we're borrowing at the same time, that we're giving away revenue based on our tax policy now? And I understand people are making the point, the money, quote unquote is cheap now, but again that's not the question, the question is, who's paying their tab? is everyone paying their fair share and have we restructured our taxes to such that those working families in North Carolina are paying a disproportionate share of what should be paid for the needs of this state? And yes years from now we may be less in debt and I heard someone talking earlier about how the debt has been paid down because of tax policies etc. And we have $445 million surplus but they didn't say who got the tax cut before, so therefore, who paid the surplus 445 million? And as we talk about this buying plan which we need, don't get me wrong, but we can't be divorced as we go through here and shop for what we need and not figure who's paying the tab at the end of the day. And I think we really have to be honest with ourselves and with North Carolina to say a disproportionate share of this burden is falling on our work in class families, and workers of North Carolina. And so yes, is going to be a great day when our dad is down but let's not act like this tax policy is fare to North Carolinian's. So we have to do better. I know some people thought the bond was going to be bigger, that would have mean't more borrowing and more of a tax debt based on how we are on our working class so when we think about tax cuts I hope we'll think about this day when we think about who paid the $445 million surplus, I hope we'll think about this day and as we go forward we'll always keep in mind and all North Carolinian's deserve that opportunity to thrive and that burden should be equitably distributed. Thank you. Mr. Speaker. For what purpose purpose does the gentleman form Wake Representative Stam rise? Will Representative Paul yield for a question? Does the gentleman form Durham yield for the gentleman from Wake? That said. For what purpose does the gentleman from Craven, representative Specialy rise? To speak on the bill. He yields. The money going to the community colleges, is there a local match for that? It is a local match that's in the bill. It's a teared match for certain things. For new construction, there is a match for existing and renovations [xx] for TIA 1 counties it's a low match, I think it's a third to one for TIA 2 counties half to one as a grater than as a one to one match. May I ask to speak on the bill? The gentleman from Craven has the forward to debate the bill. I'm going to be brief, these things started off with half to this was supposed to be transportation bond, and that no longer exist. Now it's just Christmas for the UNC and for the community colleges are going to be getting money for buildings that they don't need, some of which they didn't ask for. A lot of which they didn't ask for $2 billion, billion with a B. Some of it is going to require a match which means the counties are going to have to come up with the money If they want to get it which might mean raising taxes in some of the counties. This makes no sense whatsoever and I've heard it said on this floor. Well all we're doing is just deciding to let the voters make the decision, the voters are going to make the decision based on what? Based on what information what's the
voters really going to know when they walk into the booth there? Is it going to tell them what this money is being spent on? Are they going to Get a detailed list are they going to see what's in this Bill so they've time and make their decision a lot of what's in this Bill is ridiculous, we're putting all these Bills we're putting all this money into the UNC system to put new building for what? They can't fit the seats that they got now a lot of people are going online a lot of this seats remain empty all day long and yet we're going to put up new buildings, we're going to pull our money into this thing, we're going to put ourselves, put the state into debt we've made such great progress with the policies and programs that we've put into place up to this point to get the State out of hack to get a reserve and now we're going to put the State back into debt for something that we don't need, it's not going to fix our roads I would support this in a hot Bill if it's going to our roads, but it's not, none of it is going to the roads so the good roads state cease to be the good roads state and these two and I appreciate all the representatives vote putting to this thing, but the $2 billion dollars here, none of his is going where we really need this to go. which is into roads. I'm going to ask you to vote against it. For what purpose does the gentleman Wake, Representative Stam rise? Speak on the bill. Gentleman has the floor to debate the bill. And I'm going to vote for it. I just want to address this last argument of Representative will be paid, the general fund will pay for it because the general obligation bonds that somehow it's a burden on the so called working class or whatever sit down please. $4.1 billion would you write it down Representative Paul. That is the cumulative amount of less sales tax collected over the last four years than if we had continued on a glide path in your direction, 4.1 billion last in the regressive sales tax. For what purpose does the gentleman from Mecklenburg, Representative Brawley rise? To debate the bill. Gentleman has the floor to debate the bill. Thank you Mr. Speaker. I was looking though the chart that Representative Brody gave us and the utilization at UNC Charlotte at one point was above 100% of the University standard, I saw that there was a lack of classes at eight o'clock. I've also noticed that there's a lack of committee meetings at eight o'clock, and I know that it's difficult for guys like us to get up at eight but you know I have discovered as I get older I actually get up earlier, and when that was in my 20's eight o'clock to me was like 5AM as now, so you are okay we can't get kids in eight o'clock and maybe we could send them to class for 40 four hours a week because none of them need a part time job and they don't need to study during the day. They can do all that at night, but you'll see Charlotte is experiencing 46% of the growth in the entire UNC system 465 are asking for one client's building of labs because they say they need everyone of them and I tend to believe it. I've got an undergraduate there and I know how hard it is for her to get classes. We can probably find lots of ways to complain about our universities, but UNC Charlotte has over 50% of it's enrollment in Science and Technology and Engineering, Maths major, Physics Majors, they had a Department of Capital Electronics that's span off a company they've got a test centre that was completely funded by the electric utility industry because the need for that engineering, research and development in the Mecklenburg area was so great the building that's coming in as additional labs but also we'll support the data and informatics programme, the big data which is going to create things I can't even imagine after an entire career. Yes we're borrowing money and I must confess that I have been known to borrow money myself, in fact at the 1st of every month I make a house payment, a lot of people on this floor make a house payment, what are we buying here? houses of knowledge, factories of knowledge longterm investment, of course you finance them over 20 or 30 years, and we're hopeful that they'll produce knowledge that will benefit this state for hundreds of years,
create jobs that do not exist, create whole industries, whole technology. Imagine how much we've go these small computers, and the phones in our pockets none of that existed 30 years ago. I'm going to support this bill, I think it's a conservative, smart, businesslike way to run this state, we're investing in the future and I'm voting yes, I'd ask you to do the same. What purpose does the gentleman from Union representative Brody rise? Thank you Mr. Speaker, just second time briefly. Gentleman wants to debate the bill a second time. When I earned my degree I got Bachelor's degree and it's certainly wasn't made very little traditional, it was all in evenings, and I mean I wasn't living here, I was in Wisconsin and I was doing Citing in Wisconsin, and of course Wisconsin has got some pretty wacky whether, most of it is Winter there anyways, but there are times when I had to work outside and it was maybe 15 degrees whether 50 or 20 miles away and up to side and at the end of the day I packed up all my tools in my truck and I drove the other side of Milwaukee County to Concordia University, and I went to school for four hours and I sat there, and I stocked through for years and a half and then in finishing my degree, so I ask what are we offering the studies of UNC system? Are we offering convenience? Do we have to build another building so we can make sure the classes are only offered at nine, 10, 11 and 12 one two in the afternoon, because there be ones to get up but only wants to stay a little later, this is availability folks this is what we mean by availability if want your education you will show up at the times that are available and that may mean eight o'clock at night, it may mean I don't have a seven o'clock class but it may mean something early, you just plan how to do it, and what we're doing over here because the capacity is still low and mind you Representative Rawley says UNC was at 100%, the target rate is not at 100%. Target rate is about 75%, the actual 100% is way up there and they never even touched it. Are we going to build more buildings or just playing convenience because our students and our professors don't want to get out of bed early while they don't want to stay late. I ask you as a business decision and all you folks in here that are business people, if you have available capacity why are you investing more in capacity, why are you investing more in that strictly as a business person?
