And I'm amendment for particular reasons, there been passed bills, I have allowed the train to leave the station, when I had what seemed to be a small concern that bill and it turns out to be a bigger concern later on. So I've determined that I'm going to start standing up when I see those small issues I'm doing this cause I think it's very important, certainly with the amount of respect I have for the bill sponsor. My amendment here is changing the number of contacts that we have page three, line 25, we had a big discussion last week. And to continue the train analogy, I'm afraid both sides were off track completely talking about this issue. It's not an issue of are there enough job contacts being made, or there're too many being made by the person in order to get their employment. The issue here is it's truly, it's an administrative technicality and it needs to be three and not five. The number five came from the head of DES. And, he's walked that back after considering the impact on employers in North Carolina. He walked it back and said it needs to be three and to match 44 other states in the Federal Department of Labor. For rule making purposes the DES could add more contacts later on in the details if they wanted to. If you look at the language in the bill it says at least three or five depending on which which version it is. This is going to be a tremendous burden to employers if we put five in there. It doesn't match most other states and we already heard members of both side just stand up and talk about how people come in to get applications for jobs that they really don't have any qualifications on wasting everyone's time. Members of both side have mentioned as an issue. Another initial issue by the senate not wanting any changes to this. We did have a number of people who voted against this, I think with this amendment we actually could have a unanimous vote, I would hope that will the Senate that this is important. They need just to concur and go on with this dying motion and working for three years and that's the deal with the Governor I really think it is important. We are going to have a problem around about December I believe if we don't change this to three if we leave it at five. So, with the risk assuming to be too picky I really hope you will support this bill change it to three and it has nothing to do with the number we have already fixed the issue of unemployment by lowering the rate and lowering the time that you can get an employment that will take care of people taking jobs, thank you Mr. Speaker. For what purpose does the lady from Davy representative Howard rise? To speak on the amendment Mr. Speaker. The lady has the floor to debate the amendment I've been here a long time and the most abusive thing that you continue to hear in this chamber is, well, the senate won't do this or that. This is the way the senate wants it, and we have have to do certain things because this is the senate dictating. But let me tell you on this one bill, they have sent a very clear message, we have worked on this senate bill 15 for months. It came in passed the senate it came over, it went up to rules. It was in rules for several months, representative Lewis worked with Senator Rucho and all of the recommendations and if you have a copy of your bill, if you pull it up you're going to see there's some very serious things that incorporated in this bill. Some of the things that our department has been doing over the last two years, and I don't want to use the word not legal but it's not [xx] and all of the things that they are covering in this bill will rectify those things that are in question. The senate stood [xx] the bill sponsor stood in this chamber day before yesterday and I appreciate representative Jordan, but I ask him to turn and speak to the senator, they are through with this bill. they are done, but they are not going to go conference with. If we have vote for them, then I'm not going to find their amendment I'm going to say that thought vote of conscience as representative Jordan said and I had great respect for him, it's nitpicking, that's what it is, it's nitpicking taken, and on a normal day, I would say, "let it go"
we go to conference with it and somebody will work it out, but this issue is bigger than this amendment. I'm going to ask you to vote no in respect the senator Rachael's request there has been hours and hours of time put in to correcting what was broken over there. We fixed it, we paid the debt, we're headed in the right direction with the reserve count everything is headed in the right direction. The secretary asked for five more to go. If he has changed his mind I think with the Speaker I hope we'll continue to have the Oversight Committee, there're still tweaks and changes that occur everyday. Another member brought me a question just last week and said what about this? I said well it hasn't been addressed. It is forever changing but it is something that we need to stay the course and if this bill stops today because of this amendment, and there may be two or three, I don't know, that matter, if is one bring them on, bring them all on. The Senate is not going to move any further, they have been very be firm about it. I ask you with all due respect to vote No on this amendment and let's get it fixed this time, and moving on and then the oversight committee, which is three members from the minority party and three members from the majority party can sit again and work through all of the problems that we've had with the Division of Unemployment. I ask you to vote No. For what purpose does gentleman from Mecklenburg, Representative Bradford rise? Debate the amendment. The gentleman has the floor to debate the amendment. So I first want to thank Representative Jordan for the amendment, but I do want to offer a slightly different perspective. I'm certain that I'm not the only job creator or employer in this room, but I have an example to share with you that's very real and very relevant. I own a company that has 40 W2 employees, my company continues to grow, and I have three job openings for the last 90 days because I've had to [xx] people for non performance, people who have now sort and won unemployment which is a whole. So I have three job openings that have salary packages of around $40, 000. Now this men earn $100, 000 paying jobs, but they're not at $15, 000 jobs either. We have posted job openings on places like Indeed, monster, Craig list, looking for people. Do you know how many applicants who are unemployment have come seeking work at my company? Zero zero, so I'm an employer. I am not bothered by anyone who's unemployment seeking for employment, I welcome it in fact the more the merrier. The more applicants I have for a job the better chance I'm going to get the quality person that I want for my organization. I do not do this as an injustice to make the requirement five. I think it's extremely reasonable on the type of age of technology that we live in. People who're unemployment essentially just left or was terminated or for whatever reason no longer have a job than which they were required to go somewhere five days a week and now we're asking them to make five job contexts at their own will, at their own speed, their own pace. It could be five in one day, it could be one day for five to straight days, it doesn't matter they have that autonomy, what's the big deal. I encourage you to vote against the amendment, I think it's common sense and as an employer please bother me a lot because I'm hiring. For what purpose does the gentleman from Craven, Representative Speciale rise? Speak on the amendment. The gentleman has the floor to debate the amendment. This is a no brainier here we're giving money to people that are unemployment and we're asking them one time at least one per day to talk to an employer. Short of telling them you
can sleep all week how much easier can it get it's not unreasonable to say one employer per day. The reality is that people that are unemployment should be looking eight hours a day, five days week trying to gain employment I mean that's the reality, that's how it used to be done, but a lot of folks, there are a lot of folks out there regain the system, and there're some folks, I have been in a position where I have heard people and ones I told them we've got the job, I will come back in an hour, here's the uniform to put on to back an hour I never hear from him again. They didn't want the job, they just wanted to fulfill their commitment to get there. I get it, I get that that's going to happen on occasion but you know what, one job per day, one employer per day that's hardly putting a burden on the ones that are getting cheques to help them survive. It's not a burden it's something we should have done a long time ago, one per day ladies and gentlemen, please defeat the amendment. I think often, much often too that we for some reason look at the people and the unemployment has been inherently bad, and I'm not one of those kind people. I think people are inherently good and I think that people out there seeking job employment or hiring good and trying to produce the best county job. Not everyone will be happy that bureau system we shouldn't be angry at all of them we should be angry with those that abuse the system, which we have address and other registration we could frag address in future registration but you're saying that quite often we go when they attempt to punishing all for the sins of appeal and, I support the members and hope others will as well. For what purpose does the gentleman from Mecklenburg Representative Jeter rise? To debate the amendment. The gentleman has the floor to debate the amendment. Let me start off by saying something that I think it's important and I truly believe all 120 of us in this room believe. The vast, vast, vast super-majority of people who find themselves on unemployment are going to do everything they can to find work I don't subscribe to the theory and I don't believe anybody in this room subscribe to the theory. That these people are working looking hard for jobs. I don't believe that. Other bad actors, there's bad actors in everything, in every issue and every circumstance of life. So I don't think this amendment has anything to do with punishing anybody. I think it has to do with trying to encourage. I also think that in some degree we have to trust the process. Representative Howard who sits in seat number one, because she's been around a long time she's still young looks great by the way. But representative Howard sat on a committee that unanimously agreed five was the right number. They were three senators in that committee my good friend Skip Stam just said it would defy logic if the Senate didn't agree, I've met the Senate! They defy logic! So if the argument is, this is not about punishing these people that need work, it's about trying to find a way to help, I strongly believe everybody who, you know what? If my good friend Josh Dobson was out of a job, and he hates me and my seatmate right now, now he's going to look for 20 jobs a day. That's not what this is about. This is about trying to set together parameters to make sure that we are doing whatever we can with the employers
money, and asking for five based on a unanimous recommendation by an oversight committee that this body put together is the right decision and it shouldn't be over ruled by one individdual in this case secretary Fowell who changed his mind. We are talking about five a week, on a unanimous recommendation by the house in the senate, and right know if that doesn't tell you we should vote no I don't know what will For what purpose does the gentleman from Chowan representative Steinbug rise? To speak on the amendment. The gentleman has the floor to debate the amendment. Ladies and gentlemen of the house I find it interesting that we've gone from thinking that perhaps searching for five jobs is a little bit to much to ask of the folks who are seeking employment and now we're arguing that the employers are burdened because they've to hand out recommendations and talk to folks who are coming in looking for a job, they're both participant in this process. The number five is not unreasonable as has been mentioned many times I'm not going to be redundant but the argument that an employer resolve the burden by this folks coming and seeking employment to me beyond the pale. Representative Howard, I didn't know this amendment was coming today, but I had actually been thinking about this very issue the other day after we had already voted and this has been discussed. And I do get the thinking sometimes it does take and I understand we want those on unemployment to be actively seeking workers hard as they can do it, but sometimes it does take a while and I'm wondering if you go to four, five, six weeks or even longer is it practical to keep finding what if you've already what if someone have already exhausted all of the leads and the and the employers they can think of does.. Is the test under this bill met if you go back to another employer for like the seconds, third, fourth or fifth time over time to inquire again as to whether they will hire you. We know that would be up to the person's looking for the job. I think that thing change every, week there's new jobs that are created in there with industry every week so they though may not be hiring today in two weeks they may be and there's the great possibility that the person that is in one career path and working in one job may totally change and go to a different profession and find employment there. I can't give you a Yes or No answer, is five the right number? Is three the right number? Are the contacts the right solution? We have to look at it as we go forward, that's worked in other States. In North Carolina's plan is different, we made it different purposefully in order to achieve re-employment for our folks. All of the resources are there for resumes, for how to dress for a job, we've put all the tools in place for clothes to find a job, but I can't give you an answer of the right number of contacts or what's right or wrong. Follow up, Mr. Speaker. Does the lady yield to an additional the question? Yes. She yields. I'm just wondering what technically under the bill would qualify as, would meet the test that, hey! today I made a contact after this week I made five. Suppose I lost, I was not re-elected, I lost my job at home and I come down here, and everyday I go to the speaker's office. I'm on unemployment, I go to
speaker's office, would you hire me on your staff? No. And on Monday he says no right? So I've got a contact, I've been turned down. Tuesday I show up, and I ask him, would you hire me on your staff? and I go through that for the whole week, the second week I do it again, the third week I do it again, I'm I meeting the test under this bill will I still qualify if I just pick out one employer, and ask them everyday if they'll hire me, is there any requirement that it has to be desperate employers? the word here representative Bress the common sense, even if an employer turns you down, flat no, I'm not hiring, you're not qualified I would hide that out of good common sense, you would look elsewhere, instead of just beating a dead horse to death that would obviously be what you will be doing. But I really want to work for the speaker? For what purpose does the gentleman from Wake representative Penlinton rise? What purpose does the gentleman, does the lady from Davie desire further debate? For what purpose foes the gentleman from Ash representative Jordan rise? To debate the amendment a second time? The gentleman has the floor to debate the amendment a second time. Well, we have my expectations once again we've gotten off track what is the right number? The language says at least, so people can do whatever. The current law says is two on separate days, we're moving it to either five or three, we're increasing it either way. The and now make people go to look for jobs we have lowered the number of weeks if you can get it and we have lowered the maximum amount that is where we will get people getting jobs right after we did make the policy change or we talk about here with three, is an administrated policy decision to match 44 other states so what is the right number. In order to be consistent across the nation, 44 and pick three, that seems to be the number that was the works people can choose more and more to get a job all I'm saying here is not a burden is not too many and none is purely is an administrated number and is one of the biggest distant or we can run an issue on an administrated issues in December if we don't to make it three and much four in the state special in the border counties. I appreciate it, since we got off on a track about people's entitlement to unemployment benefits and a lot of comments were made about whether people merit them, or whose money it is, and those types of things, and I'd hope that we'd remember that in order to qualify for those benefits, you must have work at least three of the previous four quarters, and the benefits are based on that work history. So a lot of times we somehow create this fictional character that someone's just walking in off the street, who hasn't contributed and didn't have these funds taken out of their employment from their previous time. And so I would hope we would respect all North Carolinians who do in fact put in the time and want to find jobs, and who do work, and if they are getting unemployment benefits, we keep in mind that that meant they did work during a period of time to support our State and their community and their family, and they may have fallen upon hard times. So I hope we'll always consider that when we create this mythical figure that gets unemployment benefits without having worked and produced and provided some help to their community.
