There already is a procedure for assessments by counties or cities that does not require a petition by landowners, but rather just a vote by the county commissioners or city council, and this particular procedure does require a petition by a majority of landowners who must represent 66% of the assessed value. The Local Government Indemnity[sp?] has to be approved by the Local Government Commission, and this is for infrastructure. The Local Government Commission has to approve this type of procedure, and the Local Government Commission has requested, and the State Treasurer's Office has requested an amendment, which I'll offer in a minute, to reduce the time for paying back from 30 years to 25 years I think that's more prudent, and that's in their normal rules and guidelines. Without this procedure, what counties and cities can do is an assessment that has to be paid back due and for of not more than 10 installments, so this is actually less owner is on a property owner. In my own particular, this is a statewide bill, but in my own particular town it'll be 100% because it's being used for a project called [xx] that will ultimately be a billion dollar investment with no zero incentives at all. The town will issue a revenue bond approved by Local Government Commission, and then as tracks are sold off the people who purchased the tracks that are now improved by sewer, water, roads will then pay it back over up to, whatever period the town chooses but up to 25 years, and with that Mr. Speaker, I would like to offer an amendment. Thank you Mr speaker Members of the house the bill does several things, what I consider the most important is to move disputes about pole attachments that is, how much a person who owns a pole gets to charge a person who wants to attach to the pole from the business court to the utility commission and I've always thought it was unconstitutional but whether it is or not extremely unwise to have a court do something like set rates that's not something they teach in law school or courts really can do. But we have a commission that does that called the utility commission so this transfers those cases effective immediately to the utility commission. This have been fully vetted with the public staff of the utility commission and with utility commission, itself, there's a provision for fees that the commission can charge and then it sets different criteria for how those rates maybe they [xx] determined by the commission basically saying it can consider any evidence that the commission believes to be relevant in material, make sure that there is no bundling of bills with electric service and that what it does. Allows any evidence to be consummated to the commission, and with that Mr. Speaker I would be glad to answer a question from anybody and especially from Representative Bishop. The bill gets no preference to that message or to any other message that the commission names relevant and would produce a just and reasonable result.
